2. Introductory provisions
These terms and conditions govern the rights and obligations of the seller and the buyer when purchasing goods through the online shop at bajkypredeti.sk. The buyer is a consumer or a business that submits an order. By submitting an order, the buyer confirms that they have read and agree to these terms and conditions.
3. Subject of sale
The subject of sale is digital content – the collection “New Fables for All Children” by Erika Kojšová Sýkorová:
- an audio recording of the fables in MP3 format for download (in Slovak),
- an e-book in PDF format in Slovak, English and Spanish.
Digital content is not supplied on a tangible medium. A common device (computer, tablet, mobile phone) with software for playing MP3 or reading PDF files is sufficient to use it. The digital content is intended for the buyer’s personal use only; further distribution, resale or public playback without the author’s consent is not permitted.
4. Order and conclusion of the contract
The buyer selects a product, adds it to the cart, fills in the billing details, chooses a payment method and submits the order using the button with an obligation to pay. The contract is concluded when the order confirmation is delivered to the buyer’s e-mail. Contracts are concluded in the Slovak language; the seller archives them electronically and makes them available to the buyer on request. This English version is a translation provided for convenience.
5. Price and payment
Prices are final and stated in euros. The seller is not a VAT payer. The buyer can pay:
- by bank transfer to the seller’s account (details are given in the order confirmation),
- via PayPal (including payment by card).
6. Delivery of digital content
Digital content is delivered by making a download link available by e-mail and in the customer account (if the buyer has created one) without undue delay after the payment is received. For bank transfers, this is usually within 2 working days of the payment being credited to the seller’s account. The seller does not charge any shipping or postage.
7. Withdrawal from the contract
Under Act No. 108/2024 Coll. on consumer protection, a consumer has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion. The withdrawal can be notified by e-mail to info@bajkypredeti.sk or in writing to the seller’s address.
For digital content not supplied on a tangible medium, the consumer loses the right of withdrawalif its supply has begun with the consumer’s express consent before the end of the withdrawal period and the consumer has acknowledged that by giving this consent they lose the right of withdrawal. The consumer gives this consent when submitting the order; the seller confirms it in the order confirmation.
If the consumer withdraws from the contract before the digital content is supplied, the seller will refund all payments within 14 days at the latest, using the same method by which the payment was received.
8. Complaints
If the digital content cannot be downloaded or opened, or is damaged or incomplete, the buyer shall report it by e-mail to info@bajkypredeti.sk stating the order number and a description of the defect. The seller will handle the complaint without undue delay, within 30 days at the latest, usually by making fault-free content available again; if this is not possible, the seller will refund the price paid. The buyer’s rights in respect of defective performance are governed by the Slovak Civil Code and Act No. 108/2024 Coll.
9. Alternative dispute resolution
If the consumer is not satisfied with the way a complaint was handled or believes that the seller has violated their rights, they may ask the seller for redress. If the seller rejects the request or does not reply within 30 days, the consumer may submit a proposal for alternative dispute resolution to an ADR body, for example the Slovak Trade Inspection (www.soi.sk), under Act No. 391/2015 Coll.
10. Personal data protection
The processing of buyers’ personal data is described in the Privacy policy.
11. Final provisions
Legal relations not covered by these terms and conditions are governed by the laws of the Slovak Republic, in particular the Civil Code and Act No. 108/2024 Coll. on consumer protection. The seller may change these terms and conditions; an order is governed by the terms in force at the time it was submitted. In case of any discrepancy, the Slovak version prevails.
